# Atlas Seat Selection Service

These Seat Selection Service Terms ("Terms") govern the use of Atlas's Seat Selection Service through Atlas APIs and any other Atlas-supported channels made available by Atlas from time to time. By using the Seat Selection Service, the Client agrees to be bound by these Terms.

#### 1. Service Description&#x20;

Atlas Seat Selection Service enables Clients to request and purchase seat assignments offered by Participating Airlines for Eligible Bookings through Atlas-supported booking channels.&#x20;

Atlas acts as a technology and fulfilment provider, facilitating access to airline seat inventory and processing seat selection requests. Atlas does not manage or control airline seat inventory.&#x20;

Unless otherwise notified by Atlas, Seat Selection is available only for Eligible Bookings. Atlas does not currently support seat selection requests for bookings created, ticketed or otherwise processed outside of Atlas-supported booking channels.&#x20;

#### 2. Airline-Controlled Inventory and Fulfilment &#x20;

Seat availability, seat characteristics, pricing, seat maps and seat assignment policies are determined solely by the Participating Airline.

All seat selection requests are subject to airline availability at the time of fulfilment. A seat displayed through Atlas may become unavailable prior to Successful Fulfilment due to airline inventory changes or other circumstances outside Atlas's control.&#x20;

A seat selection request is Successfully Fulfilled when Atlas receives confirmation from the Participating Airline that the requested seat assignment has been processed.&#x20;

Successful Fulfilment does not guarantee that the passenger will ultimately travel in the selected seat. Participating Airlines may change, replace or reassign seats at any time in accordance with their policies and operational requirements.&#x20;

#### 3. Atlas Seat Selection Fees &#x20;

Atlas Seat Selection Service Fees shall be charged as either the applicable In-Flow Seat Selection Fee as specified in the Client's applicable commercial agreement, subscription plan, or pricing schedule.&#x20;

Unless otherwise agreed in writing, Atlas Seat Selection Service Fees are earned upon Successful Fulfilment. All fees are exclusive of taxes unless otherwise stated.&#x20;

#### 4. Client Responsibilities&#x20;

Clients are responsible for verifying booking and passenger information, reviewing seat availability and pricing, and complying with applicable airline policies. Atlas is not responsible for errors arising from incorrect information supplied by the Client.&#x20;

#### 5. Refunds and Cancellations&#x20;

Seat purchases remain subject to the applicable Participating Airline's refund, cancellation and ancillary service policies. Unless otherwise agreed in writing:&#x20;

* Atlas Seat Selection Service Fees are non-refundable following Successful Fulfilment;&#x20;
* Airline seat charges refundable only where permitted by the Participating Airline; and&#x20;
* Atlas Seat Selection Service Fees remain payable regardless of whether the underlying booking is subsequently refunded, exchanged, modified, cancelled or unused.&#x20;

#### 6. Atlas Service Errors&#x20;

Where a seat selection issue results directly from an Atlas system or processing error, Atlas may investigate and determine an appropriate resolution.&#x20;

Nothing in these Terms shall require Atlas to provide compensation, refunds, or other remedies except where expressly required under the Client's commercial agreement or applicable law.&#x20;

#### 7. Limitation of Liability&#x20;

Atlas shall not be liable for any Participating Airline decision, action, seat reassignment, policy change or other event outside Atlas's reasonable control. &#x20;

To the maximum extent permitted by law, Atlas's total liability arising from the Seat Selection Service shall not exceed the total Atlas Seat Selection Service Fees paid by the Client in connection with the affected booking.&#x20;

Atlas shall not be liable for any indirect, incidental, consequential, punitive damages, including loss of revenue, profits, goodwill, business opportunity or traveller claims.&#x20;

#### 8. Client Access and Service Modifications&#x20;

Atlas may suspend, modify or discontinue Seat Selection, in whole or in part, at any time.&#x20;

#### 9. Acceptance&#x20;

Use of the Atlas Seat Selection Service constitutes acceptance of these Terms, together with any applicable ATRIP Terms of Use, commercial agreement, subscription agreement, product bundle terms or ancillary services addendum. <br>
